In consideration of participating in Rev Volleyball, and for other good and valuable consideration, I hereby agree to release and discharge from liability arising from negligence Rev Volleyball Academy and its owners, directors, officers, employees, agents, volunteers, participants, and all other persons or entities acting for them (hereinafter collectively referred to as “Releasees”), on behalf of myself and my children, parents, heirs, assigns, personal representative and estate, and also agree as follows:

1. I acknowledge that volleyball involves known and unanticipated risks which could result in physical or emotional injury, paralysis or permanent disability, death, and property damage. Risks include, but are not limited to, sprains, breaks, tears, etc...; medical conditions resulting from physical activity; and damaged clothing or other property. I understand such risks simply cannot be eliminated, despite the use of safety equipment, without jeopardizing the essential qualities of the activity.

2. I expressly accept and assume all of the risks inherent in this activity or that might have been caused by the negligence of the Releasees. My participation in this activity is purely voluntary and I elect to participate despite the risks. In addition, if at any time I believe that event conditions are unsafe or that I am unable to participate due to physical or medical conditions, then I will immediately discontinue participation.

3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless Releasees from any and all
claims, demands, or causes of action which are in any way connected with my participation in this activity, or my use
of their equipment or facilities, arising from negligence. This release does not apply to claims arising from intentional conduct. Should Releasees or anyone acting on their behalf be required to incur attorney’s fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.

4. I represent that I have adequate insurance to cover any injury or damage I may suffer or cause while participating in
this activity, or else I agree to bear the costs of such injury or damage myself. I further represent that I have no medical or physical condition which could interfere with my safety in this activity, or else I am willing to assume – and bear the costs of – all risks that may be created, directly or indirectly, by any such condition.

5. In the event that I file a lawsuit, I agree to do so solely in the state where Releasees’ facility is located, and I further
agree that the substantive law of that state shall apply.

6. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining portions shall remain in full force and effect.

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact, including individuals without disease symptoms. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited or limited the congregation of groups of people.

The health and well-being of our athletes, coaches and families remains our top priority. In order to minimize the risk of COVID-19 entering our environment and spreading amongst our community, we will only allow coaches & registered/scheduled athletes to participate in Rev
Volleyball Academy events or activities. No parents, siblings, spectators or any other individuals will be allowed to participate.

Furthermore, all participants in sponsored activities at Rev Volleyball Academy must agree to and abide by the following:

• If an athlete or coach is sick, they should not come to scheduled event.
• Coaches and athletes must check-in and have temperature checked via no-contact thermometer upon arrival.
• Anyone showing symptoms or registering a temperature greater than 100.4 will not be permitted to participate and will be sent home.
• Agree that there is an inherent risk of exposure to COVID-19 in any public place wherepeople are present and that COVID-19 is an extremely contagious disease that can result in severe illness or death. By attending Rev Volleyball Academy events, you are voluntarily assuming all risks related to exposure of COVID-19.
• Agree to follow Rev Volleyball Academy’s Safety Procedures set forth within the premises/building where events take place. Until further notice, we ask that only players and coaches enter the building – no spectators (including parents/guardians, siblings, etc.).

Rev Volleyball Academy (hereafter referred to as the “Club”) has put in place numerous preventative measures and enhanced cleaning protocols to reduce the likelihood of spreading COVID-19 in Club’s environment; however, the Club cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending sponsored activities at the Club could increase your risk and your child(ren)’s risk of contracting COVID-19.

By agreeing to this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily agree to the participation terms described above and assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending the Club and that such exposure or infection may result in personal injury, illness, permanent disability, and death.

I understand that the risk of becoming exposed to or infected by COVID-19 at the Club may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Club Directors, Coaches, Athletes, and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at the Club or participation in Club programming (“Claims”).

On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the Club, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto.

I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Club, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Club activity

As a legal guardian of my child, I grant Rev Volleyball Academy and any participating parties my permission to use the photographs describing the said minor as being a participant in the Rev Volleyball Academy for any legal use, including but not limited to: publicity, copyright purposes, social media, public relations, event promotion, illustration, advertising, and web content.

Furthermore, I understand that no royalty, fee or other compensation shall become payable to me by reason of such use.
